By accessing or using the Bakefetti platform, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Use of Service
Bakefetti is a marketplace that connects independent bakers with customers seeking custom cakes. You agree to use the platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the platform.
3. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
4. Baker Responsibilities
Bakers on our platform operate as independent contractors. Bakers are solely responsible for ensuring they comply with all local health, safety, and cottage food laws, as well as obtaining any necessary permits and licenses to sell food items. Bakefetti does not guarantee the quality, safety, or legality of items listed by bakers.
5. Payments and Fees
All transactions are processed securely through our third-party payment provider. Customers agree to pay the total amount specified at checkout. Bakers agree to the platform commission fees as outlined during their onboarding process.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Bakefetti and its licensors. Users and bakers retain ownership over the photos and content they upload, but grant Bakefetti a license to use these materials to promote the platform.
7. Limitation of Liability
In no event shall Bakefetti, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
8. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
